In consideration of being permitted to participate in any way in the AC Beach Soccer series, related youth soccer programming, clinics, tournaments, esports activities, watch parties, and all associated events and activities held at or near 3705 Boardwalk, Atlantic City, New Jersey, and any other event locations (collectively, the “Activities”), the undersigned participant and, if the participant is a minor, the participant’s parent or legal guardian (collectively, “Participant”), acknowledges, agrees, and represents as follows:
This Agreement releases, waives, and forever discharges: Atlantic City FC; the Esports Innovation Center; Stockton University; the City of Atlantic City; the New Jersey Performing Arts Center (NJPAC); Choose New Jersey, Inc.; WorldCupAC; Beach Soccer AC; The Live Network; and each of their respective affiliates, subsidiaries, parent organizations, sponsors, partners, vendors, contractors, trustees, directors, officers, employees, agents, volunteers, coaches, officials, representatives, successors, and assigns, as well as the owners and lessors of any premises on which the Activities take place (collectively, the “Released Parties”).
Participant understands that participation in soccer, beach soccer, athletic training, esports, and related events involves RISKS OF SERIOUS BODILY INJURY, INCLUDING PERMANENT DISABILITY, PARALYSIS, AND DEATH, which may be caused by Participant’s own actions or inactions, the actions or inactions of others participating in the Activities, the conditions in which the Activities take place (including but not limited to beach, sand, surf, weather, heat, sun exposure, boardwalk, and public-space conditions), or the negligence of the Released Parties; and that there may be other risks and losses, social and economic, not known or readily foreseeable at this time. Participant FULLY ACCEPTS AND ASSUMES ALL SUCH RISKS and all responsibility for losses, costs, and damages incurred as a result of participation in the Activities.
Participant hereby RELEASES, WAIVES, DISCHARGES, AND COVENANTS NOT TO SUE the Released Parties from and for any and all liability, claims, demands, losses, or damages on account of injury, including death or damage to property, caused or alleged to be caused in whole or in part by the negligence of the Released Parties or otherwise, including negligent rescue operations, to the fullest extent permitted by law.
Participant agrees to INDEMNIFY, DEFEND, AND HOLD HARMLESS the Released Parties from any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities (including attorneys’ fees) brought as a result of Participant’s involvement in the Activities.
Participant authorizes the Released Parties and their designees to secure emergency medical care or transportation (including by ambulance) for the Participant if deemed necessary, and agrees to be financially responsible for all costs of such care and transportation. Participant certifies that the Participant is physically fit to participate and has no medical condition that would prevent safe participation, except as disclosed on the registration form.
Participant acknowledges that participation in group activities carries an inherent risk of exposure to communicable diseases, and Participant assumes all such risks and releases the Released Parties from any related claims.
Participant grants the Released Parties the irrevocable right to record, photograph, film, and otherwise capture the Participant’s image, likeness, voice, and performance during the Activities, and to use, publish, and distribute the same in any media (including web, social media, broadcast, and promotional materials) without compensation, notification, or further approval.
Participant agrees to comply with all stated and customary terms, rules, and conditions of the Activities, including all instructions of event staff, coaches, officials, lifeguards, and public safety personnel. The Released Parties reserve the right to remove any participant whose conduct is deemed unsafe or inappropriate, without refund.
Participant agrees that this Agreement is intended to be as broad and inclusive as permitted by the laws of the State of New Jersey, and that if any portion is held invalid, the balance shall continue in full legal force and effect. This Agreement shall be governed by the laws of the State of New Jersey, and any dispute shall be venued in the courts of Atlantic County, New Jersey.
If the Participant is under 18 years of age, the undersigned parent or legal guardian represents that they have legal authority over the minor, consents to the minor’s participation, agrees to all terms of this Agreement on the minor’s behalf and on their own behalf, and agrees to RELEASE AND INDEMNIFY THE RELEASED PARTIES from any claims brought by or on behalf of the minor Participant.
I HAVE READ THIS WAIVER AND RELEASE, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL RIGHTS, INCLUDING THE RIGHT TO SUE, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
